Terms of service

These terms are the agreement between TRIP FINDY and the business that opens a GotiMail account (shown as “Goti” in Facebook’s and WhatsApp’s connect windows). By creating an account or using the service, you accept them on behalf of that business.
1. The service
GotiMail provides, depending on what you use:
- email sending through our API, SMTP and campaigns;
- business mailboxes on your own domain, with webmail;
- Storage Box file storage and sharing;
- a support desk for your WhatsApp Business number and Facebook Page.
We may improve, change or retire features. If we retire something you pay for, we will tell you in advance.
2. Your account
- You must give us accurate details about your business, and keep them up to date.
- You are responsible for everything done through your account, including by people you invite. Keep passwords private and turn on two-factor sign-in.
- Tell us straight away if you think someone else has got into your account.
- You must be old enough, and authorised, to agree to these terms for your business.
3. Acceptable use
You must not use GotiMail to:
- send spam, or email or messages to people who have not agreed to hear from you;
- send anything illegal, fraudulent, deceptive, threatening or harassing, or that infringes someone else’s rights;
- impersonate another person or organisation, or collect passwords or payment details under false pretences (phishing);
- spread malware, or try to break into, overload or probe our systems or anyone else’s;
- store or share material that is illegal, including child sexual abuse material, which we report.
Email: every marketing email must include a working unsubscribe link (we add one to campaigns), and you must honour unsubscribes. We block addresses that bounce or complain, and we may pause sending when bounce or complaint rates show a list was not collected with consent.
4. WhatsApp and Facebook Messenger
If you connect a WhatsApp number or Facebook Page, you also agree to follow Meta’s rules, including the WhatsApp Business Policy, the WhatsApp Commerce Policy and the Meta Platform Terms. In particular:
- you may only message people on WhatsApp who have given you their number and agreed to hear from you there;
- you must respect Meta’s 24-hour reply window, which the panel enforces;
- you must not sell anything Meta’s Commerce Policy prohibits.
Meta may restrict or ban a number or Page on its own decision, and we cannot overturn that. If Meta tells us a channel broke its rules, we may disconnect it.
5. Your data and your customers’ data
- Everything you keep with us — mail, files, contacts, conversations — remains yours. We use it only to provide the service to you, as described in our privacy policy.
- When you hold information about other people (your contacts, the customers who message you), you are responsible for having the right to hold it, telling them how you use it, and answering their requests. We help: you can edit or delete a customer and their conversations from the Customers page.
- While your account is open you can download your files, and read or move your mail with any email app over IMAP.
6. Payment
- Prices are shown in your dashboard before you buy, in your account’s currency. Most services are paid from a prepaid wallet you top up; packages renew each month from that balance.
- A new Storage Box includes free space for the first month, as shown when you open it.
- If your balance cannot cover a renewal, the service it pays for is paused until you top up. Nothing is deleted for lack of payment without a warning email first.
- Charges Meta makes for WhatsApp messages, if you use features that incur them, are shown before you send and taken from your wallet.
- Unused wallet balance is refunded when we close your account without it being your fault, and otherwise where the law requires.
7. Suspension and closing
- You can stop using the service and ask us to close your account at any time.
- We may suspend an account, or part of it, if it breaks these terms, puts other customers or our sending reputation at risk, or if the law requires. Where we can, we tell you first and explain why.
- When an account is closed, its content is deleted within 30 days. Download anything you want to keep before then.
8. Availability
We work to keep GotiMail running and your data safe, including backups. But the service depends on the internet and on other companies (such as Amazon, Hetzner and Meta), and we do not promise it will always be available or free of errors. Keep your own copy of anything you cannot afford to lose.
9. Liability
As far as the law allows: we are not liable for indirect losses such as lost profits or lost business; and our total liability for any claim is limited to the amount you paid us in the three months before it arose. Nothing in these terms limits liability that cannot legally be limited.
10. Changes to these terms
If we change these terms in a way that matters, we will email account owners at least 14 days before the change takes effect. Continuing to use the service after that means you accept the new terms.
11. Law
These terms are governed by the laws of Bangladesh.
